They won't pay me my money!

1 How do I go about dealing with an employer who hasn't paid me? I've made several attempts to collect payment-there's always an excuse. It has been over two months now--they are down right disrespectful. I'm thinking of taking them to court. Any suggestions on how to deal with such a matter?

State labor board?

Go file a complaint with the Labor Board. You might also get a penalty amount on top of the money owed.

Much more detail would be required in order to post useful information.What kind of employment services did you provide?Were you an employee of the corporation or an agency employee?What proof do you have that you provided nursing services to the entity?How much do they owe you? (amount will help determine in which court you file)

If I may ask, what was the employment situation? PT employee, independent contractor, etc. And yes, you do have the right to be paid for work done. If it was contracted, what was stated in the contract? This is the type of question that needs more information about the type of employment venture. Where you working for a friend and now that friend doesn't want to pay? Lots of law to consider here, and of course, we can't give out legal advice per TOS.

Word to the wise: I went to the state after an employer gave excuses as to why I hadn't received my pay for the last week of work. The state informed me that they could only force them to pay me minimum wage for the hours I worked (which was only a 1/3 of what I was owed). I would try to work it out with the employer some more if this is the same case in your state. If you are a current employee I wouldn't go in any more. It's likely you won't be paid for it. Report it to BBB and any other organizations that can tarnish their reputation. If it is a claim you can make in small claims court, do that instead of going to the state.

This happened to my husband and we contacted the labor board. They called the employer that same day and he had a check very shortly

I worked for an agency, administering flu shots. I no longer work for them as of November 3. They consistently give me excuses whenever I called. I haven't been paid for nearly two months! I tried to work it out with them, they hung up the phone on me several times today, very disrespectful! Payroll speaks to NO ONE. The director isn't accepting ANY calls. I have decided after calling them every week since october with no resolve, enough is enough. Now, they have left me with no choice. I will do my best to put this company to the ground. THEY ARE HORRIBLE!!How do I contact my labor board? I may definitely file a claim in smalls court if all else fails. I was told to report them to BBB...will do :-)

My advice? Stand in front of their head office with a big sign spelling out your complaint, and make sure that all the local media knows about it beforehand. I'm sure you'll get your check before the day is over.

You can find the number to the Labor Board under your state government listings in the phone book. Or you can look online.
