A very difficult decision

Hello, all I have a very difficult decision to make, well I've made my decision but would like to get different view points on my decision made. I can sometimes be blind to certain things and a different perspective would be nice. Well here goes.....(lol).


I have been working for a company for six years and they paid for my education which I am very thankful. I have been working nights since employed but work various shifts for them and even did doubles on the weekends for almost two years but felt like death and switched back to nights solely. I have charged on days and evenings and am charge on nights as well. I've had various medical issues since about three years ago and I've tried to resolve and had a surgery to correct it I had a parathyroidectomy due to tumors that where found. I have also had some cardiac issues as well which i thought was due to my whole parathyroid issues, but even with that resolved im still having cardiac issues along with that custody issues with my ex husband.

I have had a lot going on and really needed to change to days but been holding on. So recently I got hospitalized for abnormal EKG and my physician believes its night shift I'm not getting proper rest and just stress so they say. I use to work five nights straight and then changed that I just dont know what else to do and I don't even work 40hrs a week I've never have Well I asked my employer if possible can I switch to days if something is available. Well two weeks later it did so I had to put it in writing that I want the position so I did. Well they called me and said we got your note and your the only that has applied so far but we want to wait and see if any one else applies....
Please consider editing to add paragraphs. That wall of words was too intimidating at this time of night after the shift I just had.

You are in a tough spot. This is why I do not want to "owe" an employer for paying for my education. Your employer becomes a jail that you have to serve time at or else find yourself in this very spot. OP - I'm sorry I don't have much to offer about your situation. Talk over your options with your significant other and go from there. Good luck either way.

I would seek legal counsel. Realize that you are identifiable by the information you have posted.

Depending on what State you are in, these may just be empty threats. If you work in a "right to work" State it would be hard for your employer to enforce the contract. Depending on the amount of money, it may not even be viable for them to go to a whole lot of trouble to try to get this money out of you - it will cost them more in attorney fees than it is probably worth. As far as them "wanting it now" I really think they are pushing their luck. If you offered to make payments that is more than generous and they should take their money and shut up. BTW, make sure that they are pro-rating anything you owe. I don't believe it would be legal for them to charge you interest on any amount owed unless you signed a loan agreement prior to employment. Basically, don't be intimidated into signing something else with them at this point unless you know your legal rights.

I agree.Consult an attorney. Bring any documents that you signed when you agreed to work with/for them.

I don't understand why you had to interview to stay at your current employer to go to day shift. That doesn't make any sense. Although I have seen an employer do this, and not give that person days and they quit as a result. If you didn't get days it should go to someone with more seniority, but neither one of you should have had to be interviewed. As for paying back your employer, I suggest legal counsel.

After six years, this employer is treating you extremely crappily. To make a long term employee interview for a simple change of shift? Sorry this is happening.
