I don't know what to tell you other than a new place to work would be a blessing for you...As far as the HIPAA violation, if it's not pursued to the higher levels, a slap on the wrist is probably all she'd get. When they have to fork over the ?$50,000? for the offense, the individual miiight be in another type of boat.

I would love to say that bad facilities eventually get caught, but that's not the case. You could report them, but plan on looking for a new job sooner rather than later. They cannot technically fire you for the report, but as we all know there are a million reasons to fire a nurse. The state will investigate, maybe find something wrong, slap a fine or a wrist, and nothing will change. I'll bet this facility is real good at covering their behind.You can just work there, wear your blinders, and do the best you can. You will change nothing if you stay. Or you can quit. You can only take care of yourself.I regret that my post is so negative, but it is accurate.

If an incompetent nurse's actions lead to the death of a patient, that needs to reported immediately to your state BON, JCAHO, and AHCA if necessary. I'd also start looking for a new job. Chart, care for your patients, and cover your butt at all times.

If you can provide documentation and/or proof notify state BON or your certifying agency (JCAHO?). If something bad happens make sure that you look like the competent voice of reason on paper (i.e. provide honest, complete documentation in your charting). If you are privately owned consider notifying the big bosses, after doing a risk-analysis for your job protection. They might love to know they are being put in legal jeopardy every day. Assess whether you have the means and will to effect change from within, or look for a better work environment. If patients are at risk, you are should definitely report it, perhaps timed with your resignation.
