Equipment Breaking during a home health visit

1 I need some advice. Can a client sue a nurse for being the one who happened to be pushing the button on a wheelchair lift when it broke? There weren't any other circumstances and no one was hurt. It was just being lifted back into the van so it could be closed. Something on the bottom caught on the bottom of the van and it was stuck for a few minutes but it was workable and usable after.

So even though the nurse was only pushing the button (and it could have happened if anyone was pushing the button), is she responsible to pay for the 'damages'?
No. Talk to your employer. They would be liable, if anyone. But it broke with normal use. Your employer should set this right. Of course don't go back to this client.

Don't go pushing any panic buttons, but technically anyone can be sued over anything. That being said, being sued doesn't mean you are automatically liable for any damages. If you are sued, you will have to defend yourself, nonetheless. Defending yourself against a frivolous suit or claim can be expensive. That's why it's best practice to have your own malpractice insurance. It covers your defense as well as any damages for which you might be held liable.
