Mistake... now State Board is Calling

I recently made a mistake, violated Hippa, and was terminated from my job. The short version is a close friend asked me to find out what room her grandson was being moved to because they couldn't get a hold of anyone in the room, d/t a code in progress. I searched within the pts lists to find locate the pt. I couldn't locate them, went to the floor and spoke with the other grandparents (who were in the room), and she informed me where the pt was being transferred. I started to call the other grandmother and the manager saw me, questioned what I was doing and informed me that the pt was a No Information Pt because CPS has started an investigation. I had no idea! So I called the friend and informed I couldn't give her any info.

Now the state board of nursing is requesting my letter of explanation regarding the events in question. Do I just send them the letter or do I get a lawyer?

I feel nauseous over this and am so mad at myself.
Call your nursing liability insurance carrier immediately; they will provide a lawyer to help protect your license free of charge. If you don't have your own insurance, most lawyers will at least give you an initial consultation for free (they will let you know if you can or should handle this by yourself, or if you would have a better chance with legal representation). If you're a member of ANA (and sometimes, even if you're not), your state chapter should be able to recommend a lawyer or other resources. I'm sorry this happened to you and wish you the very best.DeLana

Inform your malpractice insurance carrier and seek legal advice.

The BON is not your friend--get a lawyer. Good luck.

I am so sorry you are in this situation. Granted you gave us the short version, but I am wondering if your actions really were grounds for termination? Seems to me like you were just trying to help a friend!
