Nursing Student Sues University?

I am posting in general nursing because I would like seasoned nurses' opinions, as well as students'. I have my initial thoughts on this, but am fully aware that I could be completely off base, and would like some thoughts from the nursing community that may help me see this in a different light.

So, here are my initial thoughts... she is probably suing for the cost of what she owes in tuition loans (I am guessing) since she will not be able to work as a nurse to pay back those loans. My curiosity comes from this: if she feels she was mistreated why not try to force them to let her take the course under fair terms (if she was truly treated differently).

Here's the part I probably need a view adjustment on? So she has depression and such severe anxiety that she has failed the same class twice and had numerous struggles getting through the 5 years of school (so far). No one will be there to hold her hand and answer questions during the NCLEX... or, for that matter, in all the emergency situations she could very likely find herself in as a nurse... if she cannot handle a test (where they did give her a private, quiet room and extra time), how can she expect to be able to succeed as a nurse? And how are her disabilities the college's problem? Why should they have to pay her $75,000 because she chose a path she was not capable of succeeding in? Don't get me wrong, I am all for helping with disabilities, but this idea that anyone can do anything "they put their mind to" is very unrealistic.
