Our health system uses separate staff for terninal payout of benefits and final check. Staff receive about 3 weeks post last day worked IF Manager enters employee termination promptly into payroll software. Otherwise, may take longer. Need to inquire from HR department how its handled....many are surprised when they do not get final check at next pay date.

They can't take money from you if it is earned by actual hours worked.On the other hand...... if you had a sign on bonus or some such worded thing, then they can withhold a check as "repayment" of that bonus.

No they cant. Unless you just took a sign on bonus-but then theyll bill you afterward rather than withold your paycheck.

I did sign a bonus for 2500 and was unware of the taxes they took out off 900 dollars and thats sucked.

The way it works in the facility where I am working is that they WILL take what they can from your last paycheck, but leave you with minimum wage pay for what hours you have worked on that pay period. HTH

My institution would. They have withheld money from people that broke contracts after having received sign on bonuses or got grants to get advanced degrees. You had better talk to HR.
